Operator

The operator of the service is Websitemaster, a joint stock company registered in the Commercial Register administered by the Municipal Court in Prague, Section B, File no. 11178, Company Identification Number: 276 10 128. Hereinafter referred to as "Operator".

Service

Operator renders a service pertaining to creation of websites. The respective service is available at www.ewebsite.com. Users’ websites are displayed through third-level domains at www.user.ewebsite.com. Hereinafter referred to as "Service".

User

Any natural person or legal entity may become a user of Service. Hereinafter referred to as "Person".

Person becomes the user of Service following completion of the registration form and subsequent activation of Service. Hereinafter referred to as "User".

Activation

Activation of Service is performed through the e-mail address specified in the course of the registration procedure. Instructions informing about the manner of activation of Service are sent to the above-mentioned e-mail address. User is notified of a successful completion of the activation procedure by the means of a message sent to the same e-mail address.

Use FREE OF CHARGE

Service may be used free of any charge for an unlimited time period. Furthermore, services available within the scope of the Non-Commercial and Commercial price plans may be used throughout the 30-day trial period. Following elapse of the trial period the parameters of Service are set up in accordance with the valid pricelist. User may place his/her own advertisements or advertisements promoting third parties to websites to be operated free of charge.

Non-Commercial Use

The website may contain neither any advertisements promoting User or any third parties nor an external code serving for advertising purposes. The website may not be used for presentations of companies, services or products.

Commercial Use

The commercial website may contain presentations of companies, their services and products. Third-party advertisements may be placed on the website.

The scope of commercial websites includes:

• Website of a company or a sole trader;
• Website containing advertisements (banners, advertising systems);
• Website containing classified advertisements (sale of products, animals or goods);
• Website containing a pricelist of products or services.

Commercial websites are subject to a 30-day trial period. Following elapse of the trial period it is necessary to order a tariff plan.

Subject to the valid pricelist, reimbursements pertaining to the non commercial and commercial tariff plans are in the form of lump-sum amounts; no refunds may be granted. A free-of-charge demo version of a paid tariff plan is set up from the time of ordering of Service until the time of reimbursement of its price.

User is not entitled to claim any refunds on the grounds of termination of Service on behalf of Operator.

In case of a payment in a foreign currency, the exchange rate of the Czech National Bank applicable as of the day of tax discharge realization is to be used for conversion to CZK.Termination of Service

Operator hereby reserves its right to terminate Service – without specifying the respective reason – on condition that

• Website breaches the laws of the Czech Republic or is inconsistent with good manners;
• Content of the website damages Operator’s reputation;
• Website contains solely a link to commercial services, resp. a link farm;
• Website is not active; no access to administration of the website has been recorded for more than 3 months (does not apply to paying Users);
• User breaches the Terms and Conditions;
• No contributions, pages or photo galleries were inserted within a month from the time of registration;
• Website promotes warez links or refers to any such websites.

Other Dispositions

Operator hereby undertakes not to provide any personal data to a third party. Provided data shall be used solely for the purpose of mutual communication or rendering of ordered services – within the scope essential for the purpose of rendering of services.

Access to the personal data and their correction is to be granted on User’s request at any given time.
User is entitled to require an explanation, resp. compensation of any damages, should User believe that Operator uses any personal data in a manner inconsistent with the legislation or contrary to the principle of protection of personal and private life.

Operator hereby reserves the right to alter the Terms and Conditions as required.

Operator is the author of the template, software and Service as such.

Operator does not assume any responsibility for the content of Users’ websites.

Provision of Services and their scope are subject to the valid pricelist which is published on Operator’s website.

Operator shall strive to ensure maximum functionality and availability of rendered Service.

Operator does not assume any responsibility for any damage resulting from loss or damage of stored data.

User hereby undertakes not to misuse the system or overload the server in any other intentional manner.

Operator is entitled to delete domains of a speculative nature.

User undertakes to publish solely the content which complies with the legislation and does not breach the rights of Operator or any third parties.Remark

The content of websites that is not suitable for persons younger than 18 (erotic content, etc.) may be placed solely on password-protected websites (see Locking of Websites)!
